Welcome to DriveHub Auction (“DriveHub Auction,” “DriveHub,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of www.drivehubauction.com (the “Website”) and all related auction, vehicle listing, bidding, purchasing, selling, account, and other services provided by DriveHub Auction (collectively, the “Services”).
By accessing the Website, creating an account, listing a vehicle, placing a bid, purchasing a vehicle, or otherwise using the Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not use the Services.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Services.
- You are at least 18 years old.
- The information you provide is accurate and complete.
- You have authority to enter into transactions you initiate.
- You will comply with all applicable federal, state, and local laws.
- You will not use the Website for fraudulent, unlawful, or abusive purposes.
DriveHub Auction may refuse registration or terminate an account if we determine that a user does not meet these requirements.

Users are responsible for reviewing all available information before bidding or purchasing a vehicle.

- Photographs
- Videos
- Vehicle identification numbers
- Mileage
- Vehicle history information
- Condition information
- Title information
- Modifications
- Service history
- Other information relating to the vehicle
4. Vehicle Condition
Vehicles sold through the Website may be used, collectible, classic, exotic, modified, damaged, restored, rebuilt, or otherwise subject to wear and condition issues.
Unless expressly stated otherwise in writing, vehicles are sold based on the condition disclosed in the applicable listing and are not guaranteed to be free from defects.
Photographs and videos are provided for informational purposes and may not show every defect or condition issue.
Normal wear, mechanical issues, cosmetic imperfections, previous repairs, modifications, age-related deterioration, and other characteristics may exist.
Buyers are strongly encouraged to perform their own inspection or have an independent inspection performed before placing a bid.
5. Due Diligence
A buyer is responsible for performing appropriate due diligence before placing a bid. This may include reviewing:
If you are unable to inspect the vehicle personally, you may arrange for an independent third-party inspection, subject to seller approval and reasonable scheduling requirements.
Placing a bid constitutes acknowledgment that you have had a reasonable opportunity to conduct your own due diligence.

6. Bidding
By placing a bid, you are making a binding offer to purchase the vehicle at the amount of your bid, subject to the applicable auction rules and any stated reserve requirements.
You should not place a bid unless you are prepared and financially able to complete the transaction.
Once submitted, bids generally cannot be withdrawn.
DriveHub Auction may, in its discretion, cancel, reject, remove, or invalidate a bid if there is a reasonable basis to believe that the bid resulted from:
- Technical problems
- Fraud
- Bid manipulation
- User error
- Collusion
- Unauthorized account activity
- Violation of these Terms
- Other circumstances that may compromise the integrity of the auction
7. Auction Closing
An auction closes according to the closing time displayed on the Website.
DriveHub Auction may extend or modify an auction closing time when necessary because of technical problems, unusual bidding activity, system errors, suspected manipulation, or other circumstances affecting the integrity of the auction.
The highest valid bid at the conclusion of an auction may become the winning bid, subject to any applicable reserve price, seller approval, or other conditions stated in the listing.
8. Reserve Prices and Seller Approval
Some auctions may have a reserve price.
If the reserve price is not met, the vehicle may not be sold unless the seller agrees to accept the highest bid or otherwise approves the transaction.
DriveHub Auction does not guarantee that a vehicle will be sold solely because a user submits the highest bid.
Auction-specific terms displayed on the Website will control when they differ from these general Terms.
9. Winning a Vehicle
If you are the winning bidder, you agree to complete the purchase in accordance with the applicable auction terms. After winning an auction, DriveHub Auction or the seller may contact you regarding:
- Payment
- Required documentation
- Title
- Pickup
- Shipping
- Registration
- Taxes and fees
- Other transaction requirements
Failure to complete a winning transaction may result in suspension or termination of your account and may subject you to additional consequences permitted by law.
10. Purchase Price and Fees
The total amount due may include:
Any applicable fees will be disclosed through the Website, listing, checkout process, invoice, or other transaction communication.
You are responsible for paying all applicable taxes and governmental charges unless otherwise stated.

11. Payment
Unless otherwise agreed in writing, payment must be made using a payment method accepted by DriveHub Auction or the seller.
DriveHub Auction may require payment within a specified period after an auction closes.
Failure to pay within the required period may result in:
- Cancellation of the transaction
- Loss of bidding privileges
- Account suspension
- Additional fees or costs where permitted by law
- Other remedies available to the seller or DriveHub Auction
A payment may be subject to verification or approval before a transaction is completed.
12. Titles and Documentation
Title and registration documents are subject to the information disclosed in the applicable vehicle listing and transaction documentation.
DriveHub Auction does not guarantee that a vehicle will qualify for registration in every state or jurisdiction.
Buyers are responsible for determining whether a vehicle's title, condition, history, emissions status, equipment, or other characteristics comply with the laws and registration requirements of the buyer's jurisdiction.
13. Taxes
Buyers are responsible for applicable sales tax, use tax, registration fees, title fees, documentary fees, and other governmental charges associated with the purchase of a vehicle unless otherwise stated.
Tax obligations may vary depending on the buyer's location, seller's location, vehicle type, and transaction structure.
14. Pickup and Shipping
Unless otherwise specified, the buyer is responsible for arranging and paying for vehicle transportation.
DriveHub Auction may assist with connecting buyers with transportation providers but does not guarantee the performance, timing, price, condition, or conduct of any third-party transportation provider.
The buyer is responsible for confirming pickup and delivery arrangements.
Vehicles should be inspected at pickup or delivery when reasonably possible.
Any damage occurring during transportation should be addressed with the transportation provider and its applicable insurance.
15. Sellers
Sellers who list vehicles on DriveHub Auction represent and warrant that:
- They have the legal right to sell the vehicle.
- The information provided in the listing is accurate to the best of their knowledge.
- They will disclose known material information about the vehicle.
- They will accurately disclose title status and known title issues.
- They will not intentionally misrepresent the vehicle.
- They will provide required documentation.
- They will comply with applicable laws.
Sellers may not use the Website to engage in fraudulent activity, deceptive advertising, bid manipulation, shill bidding, or other prohibited conduct.
16. Prohibited Bidding and Conduct
Users may not:
- Place bids using another person's account.
- Create multiple accounts to manipulate auctions.
- Place bids without intending to purchase.
- Manipulate auction results.
- Engage in shill bidding or collusion.
- Submit false or misleading information.
- Attempt to artificially increase a vehicle's price.
- Interfere with another user's account.
- Circumvent Website security.
- Use automated systems or bots without authorization.
- Scrape or copy Website content without permission.
- Upload malicious software.
- Use the Website for unlawful purposes.
- Harass, threaten, or abuse other users.
- Attempt to interfere with the operation of the Website.
Violations may result in immediate account suspension or termination and cancellation of affected transactions.
17. Fraud Prevention
DriveHub Auction may use identity verification, payment verification, fraud detection, device information, IP addresses, transaction monitoring, and other security measures to protect users and the integrity of the marketplace.
We may delay, reject, suspend, or cancel transactions where we reasonably suspect fraud, unauthorized activity, money laundering, payment fraud, identity theft, or other unlawful conduct.
18. User Content
Users may submit photographs, descriptions, comments, reviews, vehicle information, messages, and other content ("User Content").
You retain ownership of User Content that you submit, subject to the rights granted below.
By submitting User Content, you grant DriveHub Auction a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify, format, and publish that content as reasonably necessary to operate, market, and improve the Services.
You represent that you have the necessary rights to submit the content and that the content does not violate applicable laws or third-party rights.
19. Intellectual Property
The Website and its contents, including logos, trademarks, designs, graphics, software, text, photographs, interfaces, and other materials, are owned by or licensed to DriveHub Auction or its respective owners.
You may not reproduce, distribute, modify, sell, license, or commercially exploit Website content without prior written permission.
"DriveHub Auction" and associated logos and branding may be trademarks or trade names of their respective owners.
20. Third-Party Services
The Website may integrate with or provide links to third-party services, including payment processors, vehicle-history providers, transportation companies, analytics services, advertising platforms, and other service providers.
DriveHub Auction is not responsible for the availability, performance, policies, or actions of third-party services.
Your use of third-party services may be subject to separate terms and privacy policies.
21. Disclaimer of Warranties
To the maximum extent permitted by law, the Website and Services are provided on an "AS IS" and "AS AVAILABLE" basis.
DriveHub Auction makes no guarantee that:

- The Website will operate without interruption or errors.
- Auction information will always be complete or accurate.
- Listings will be free from errors.
- Vehicles will meet a buyer's expectations.
- A transaction will be completed.
- Third-party services will perform as expected.

Nothing in these Terms excludes warranties that cannot legally be excluded under applicable law.
22. Limitation of Liability
To the maximum extent permitted by applicable law, DriveHub Auction and its owners, officers, employees, agents, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Website or Services.
This includes, without limitation, damages arising from:
- Vehicle purchases or sales
- Auction results
- Vehicle defects
- Transportation or shipping
- Delays
- Lost profits
- Lost business opportunities
- Loss of data
- Website interruptions
- Third-party services
- Unauthorized account access
To the maximum extent permitted by law, DriveHub Auction's total liability arising from your use of the Services will not exceed the amount you paid directly to DriveHub Auction for the specific Service giving rise to the claim during the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
23. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless DriveHub Auction and its owners, officers, employees, agents, affiliates, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your use of the Website or Services.
- Your violation of these Terms.
- Your violation of applicable law.

- Your vehicle listing.
- Your bids or purchases.
- Your interactions with other users.
- Your violation of another person's rights.
24. Account Suspension and Termination
DriveHub Auction may suspend or terminate your account or restrict your access to the Website at any time if we reasonably believe that you:
- Violated these Terms.
- Engaged in fraudulent or suspicious activity.
- Failed to complete a transaction.
- Manipulated an auction.
- Provided false information.
- Created a security risk.
- Violated applicable law.
Termination does not eliminate obligations that arose before termination.
25. Disputes Between Buyers and Sellers
DriveHub Auction may provide tools or assistance to facilitate communication between buyers and sellers.
Unless expressly stated otherwise, DriveHub Auction is not a party to the underlying purchase contract between a buyer and seller and is not responsible for resolving disputes concerning:
- Vehicle condition
- Title
- Payment
- Delivery
- Shipping
- Representations made by a seller
- Ownership
- Registration
- Post-sale repairs
Users should attempt to resolve disputes directly with the other party when appropriate.
26. Governing Law
These Terms will be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute that is not subject to arbitration, if applicable, shall be brought in a court of competent jurisdiction located in Florida, unless otherwise required by applicable law.
27. Changes to These Terms
DriveHub Auction may modify these Terms from time to time.
When changes are made, we may update the Effective Date and publish the revised Terms on the Website.
Your continued use of the Website after the updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
28. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect to the maximum extent permitted by law.
29. Entire Agreement
These Terms, together with the Privacy Policy and any additional auction-specific terms, policies, or agreements presented through the Website, constitute the agreement between you and DriveHub Auction concerning your use of the Services.
If there is a conflict between these Terms and specific auction terms displayed for a particular vehicle, the specific auction terms will control for that transaction.
